ORDINANCE NO. 1, S. 2005
AN ORDINANCE IMPOSING CURFEW HOURS ON MINOR AGES BELOW 18 FROM 10:OOPM TO 4:00 AM.
Be it ordained by the Sangguniang Bayan of San Jorge, Samar, Philippines that:
SECTION 1. It shall be unlawful for any one aged below eighteen (18) considered here as minor to:
(a) Loiter or aimlessly linger on or be found in any street or public places from the hours of ten o'clock (10:00) in the evening until four o'clock (4:00) in the morning. Minors found in the street or any public place after ten in the evening shall be apprehended and turn over to the PNP Police Station for safe keeping purpose, except however, if they are:
1. Accompanied by their parents or guardian;
2. On lawful errands;
3. On the pursuit of their lawful livelihood equipped with proper identification card, which shall be issued by the PNP Police Station free of charge;
4. Going to or coming from their evening classes and/or school‑authorized activity and party celebration;
5. Proper notification of the school authorities and party host or celebrant to the Chief of Police of San Jorge, Samar, 24‑hours before the start of affair;
6. Arrival of Minor from other places to their residence.
SECTION 2. Members of the Barangay Tanod in any Barangay within the Municipality of San Jorge, Samar duly recommended by their Punong Barangay and the Chief of San Jorge PNP, maybe authorized to effect arrest and apprehend minors violating this Act within their area of coverage or jurisdiction;
SECTION 3. Members of the React Communication Group duly recommended by the Chief of Police of San Jorge PNP Station may also be authorized to effect arrest and apprehend minors violating this Act;
SECTION 4. Penalties: Minors violating this Act shall for:
(a) The first offense be turned over to San Jorge PNP Station for proper identification and properly entered in the record book, after which, the minor will be locked up until four (4:00) o'clock the following morning. Offender shall be released only upon payment of two hundred pesos (P200.00) and will render Community Service or Cleanliness Drive for four (4) hours, from four o'clock in the morning at designated places in San Jorge to be monitored by the Personnel of the Office of the Mayor.
(b) For the second offense, the minor will be locked up until four (4:00) o'clock in the morning at the San Jorge PNP Station and will be released only upon payment of five hundred pesos (P500.00) and will render Community Service or Cleanliness Drive for six (6) hours, from four (4:00) o'clock in the morning at designated places in San Jorge to be monitored by Personnel of the Office of the Mayor.
(c) For the third offense, the minor will be locked up until four (4:00) o'clock in the morning at the San Jorge PNP Station and will be released only upon payment of One Thousand Pesos (1,000.00) and will render Community Service or Cleanliness Drive for eight (8) hours from five o'clock in the morning at designated places in San Jorge to be monitored by Personnel of the Office of the Mayor.
(d) For habitual offender, the penalty shall be Two Thousand Pesos and eight (8) hours of Community Service or Cleanliness Drive.
SECTION 5. This Ordinance shall take effect fifteen (15) days after publication in a news paper of general circulation or posting publication in public conspicuous places.
